TERMS OF SERVICE

Acceptance of terms

By accessing or using Summos.AI (the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legal agreement between you and InitRD, a French simplified joint-stock company (SASU) with its registered office at 254 Rue Vendôme, 69003 LYON, France ("Company," "we," "us," or "our").

Description of service

Summos.AI is a Software-as-a-Service (SaaS) platform that enables users to:

  • Aggregate information sources by adding API keys from digital news publications
  • Filter articles using custom prompts and AI-powered content curation
  • Generate PDF summaries containing filtered content
  • Deliver PDF reports via email or directly to Kindle or reMarkable tablets

The Service is currently in beta testing phase and features may be modified or discontinued at any time.

User accounts and registration

Account creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

API Key Management

You may provide third-party API keys to access news sources. You represent that you have the legal right to use these API keys and that your use complies with the terms of service of the respective news providers.

Subscription Terms And Billing

Subscription Plans

The Service operates on a monthly subscription basis. Current pricing and usage limits (including number of articles processed, API sources, and PDFs generated) are detailed on our pricing page at Princing.

Free Trial

New users are eligible for a 3-day free trial. No payment information is required during the trial period. The trial automatically expires after 3 days unless you upgrade to a paid subscription.

Billing and payment

  • Monthly subscriptions are billed in advance
  • Any partial month of service is charged as a full month
  • Payments are processed through Stripe
  • All fees are non-refundable except as expressly stated in these Terms

Refunds

Refunds may be issued at our sole discretion via Stripe to the original payment method used for the subscription.

Changes to Pricing

We reserve the right to modify our pricing at any time. Price changes will take effect at the start of your next billing cycle and will be communicated to you in advance.

Data Handling and Privacy

API Key Storage

  • Your API keys are stored securely with your explicit consent
  • API keys are retained only for the duration necessary to provide the Service
  • API keys may remain in backup systems for up to 30 days after deletion
  • API keys are used exclusively to provide services to you and are not shared with other users
  • Our handling of API keys complies with contractual agreements with news sources

Content Processing

  • The Service does not retain copies of processed news content beyond the immediate processing period
  • Generated PDFs contain articles copied in their original form from the respective news sources
  • Content within PDFs remains the intellectual property of the original news sources
  • Your use of aggregated content is subject to the terms and conditions of the original news sources

Personal Data

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable.

Intellectual Property Rights

Service Content

The Service and its original content, features, and functionality are owned by SummosAI SASU and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Third-Party Content

Content aggregated through the Service remains the property of the original news sources and publishers. You acknowledge that:

  • We do not claim ownership of third-party news content
  • Your use of aggregated content must comply with the terms of service of the original sources
  • You are responsible for ensuring your use of aggregated content is lawful
  • The Service operates under fair use principles for content aggregation and personal use

User-Generated Content

You retain ownership of any content you create using the Service, including custom prompts and configurations. By using the Service, you grant us a limited license to use this content solely for the purpose of providing the Service to you.

Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or in violation of any applicable laws
  • To infringe upon the intellectual property rights of others
  • To distribute copyrighted material without proper authorization
  • To violate the terms of service of news sources whose APIs you use
  • To attempt to reverse engineer, hack, or compromise the Service
  • To use automated means to access the Service beyond the provided API functionality
  • To redistribute or resell access to the Service without our written consent

Disclaimers and limitations

Service Availability

The Service is currently in beta testing phase. We do not guarantee:

  • Continuous, uninterrupted access to the Service
  • Error-free operation of all features
  • Compatibility with all third-party services and APIs
  • Specific levels of technical support

Content Accuracy

We do not verify the accuracy, completeness, or reliability of content aggregated from third-party sources. You acknowledge that:

  • News content is provided by third-party sources
  • We are not responsible for the accuracy of aggregated content
  • Content filtering results may vary and are not guaranteed to be perfect
  • You should verify important information from original sources

Third-Party Services

The Service integrates with third-party services (news APIs, email delivery, reMarkable). We are not responsible for:

  • The availability or performance of third-party services
  • Changes to third-party APIs or terms of service
  • Any issues arising from your use of third-party services

Limitations of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Damages

IN NO EVENT SHALL SUMMOSAI SASU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless SummosAI SASU and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your use of third-party API keys or services

Account Termination

Termination by You

You may terminate your account and subscription at any time through your account settings. Upon termination:

  • Your subscription will not renew
  • You will retain access to the Service until the end of your current billing period
  • Your data will be deleted immediately upon account closure
  • Data may remain in backup systems for up to 30 days

Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Effect of Teermination

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Geographic Restrictions

The Service is operated from France and intended for users worldwide. However, we make no representation that the Service is appropriate or available for use in all locations. Users who access the Service from other jurisdictions do so at their own risk and are responsible for compliance with local laws.

Changes to terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after such notice constitutes your acceptance of the new Terms.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lyon, France.

Alternative Dispute Resolution

Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through good faith negotiations for a period of 30 days.

Compliance with laws

You are responsible for complying with all applicable laws and regulations in your use of the Service, including but not limited to:

  • Copyright and intellectual property laws
  • Data protection and privacy regulations
  • Export control laws
  • Anti-spam and communications regulations

Severabbility

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SummosAI SASU regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

Language

These Terms are written in English. Any translations provided are for convenience only. In case of any discrepancy between the English version and any translation, the English version shall prevail.

By using Summos.AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
